1. Acceptance of Terms

By downloading, accessing, or using the Linguahan application or website (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Linguahan (16 in the EU/UK). By using the Service, you represent that you meet this age requirement. Users under 18 should have parental consent.

3. Account

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

4. Subscriptions & Payments

4.1 Free Tier: Linguahan offers a free tier with limited daily speaking usage and access to Level 1 scenes.

4.2 Pro Subscription: Pro subscriptions provide expanded access. Subscriptions auto-renew unless cancelled. Prices are in USD and may vary by region.

4.3 Free Trials: A free trial may be offered to eligible new users. Availability, duration, and any payment-method requirement are shown before the trial starts.

4.4 Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods except where required by law.

4.5 iOS Purchases: App Store purchases are governed by Apple's terms. Refunds are handled by Apple.

4.6 Android Purchases: Google Play purchases are governed by Google Play terms. Refunds and cancellation controls may be handled by Google depending on where you purchased.

4.7 Web Checkout: Where available, web checkout may be processed by Stripe or PayPal. Web checkout availability, payment methods, prices, taxes, currencies, and promotions may vary by country, account, and platform configuration.

4.8 Purchase Source: Manage, cancel, restore, or request refunds through the provider where you purchased: App Store, Google Play, Stripe, or PayPal.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit hateful, abusive, sexually explicit, or violent content
• Attempt to reverse-engineer or tamper with the Service
• Create multiple accounts to circumvent restrictions
• Use automated tools to scrape or abuse the Service

Violation may result in account suspension or termination.

6. AI Content Disclaimer

Linguahan uses large language models (LLMs) to support translation, speaking guidance, and other in-app learning features. AI-generated content may occasionally be inaccurate. Always verify important information. Linguahan is designed for Chinese language learning purposes only and is not a substitute for professional advice of any kind.

Do not rely on Linguahan for legal, medical, financial, immigration, safety-critical, or emergency advice. Translation and pronunciation feedback are learning aids and may be incomplete or incorrect.

7. Intellectual Property

All content, trademarks, and software within the Service are owned by Linguahan, Inc. or its licensors. You may not copy, modify, or distribute Service content without written permission. You retain ownership of your own recordings and journal entries.

8. Affiliate & Referral Program

Participants in the Linguahan affiliate program agree to additional program-specific terms available in the app. We reserve the right to modify commission rates or terminate the program with 30 days' notice.

9. Limitation of Liability

To the maximum extent permitted by law, Linguahan shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid to Linguahan in the 12 months prior to the claim.

10. Termination

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time via Profile → Settings → Privacy Center. Upon termination, your data will be deleted per our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Disputes shall be resolved by binding arbitration in accordance with AAA rules.
